Terms of Service

1. What the Service Is

Candeq is a platform that enables users to submit and read reviews about third-party products and services, and enables businesses to manage listings and collect reviews.

Candeq provides the platform and moderates submitted content for spam, abuse, manipulation, and compliance with our publication rules. We do not manufacture, sell, test, audit, certify, or endorse the products and services reviewed on Candeq.

We may add, remove, or change features at any time.

2. Eligibility and Accounts

You must be 18+ to use the Service.

To post a review you must create an account. We require an email address and a username. You may use a pseudonymous email and username.

You're responsible for maintaining the security of your account and for activity under it.

3. Reviews, Content, and Disclosure of Incentives

You are solely responsible for content you submit (reviews, comments, images, etc.). Do not post content that is deceptive, fraudulent, or materially misleading.

Some reviews may be written after a business invitation that includes a reward or benefit funded by that business (see section 6). If you receive any reward/benefit connected to a review, you agree that Candeq may disclose that reward or benefit, and you agree to provide any disclosure we reasonably require (for example, confirming whether a reward was received).

4. Acceptable Use

You agree not to:

• break any law or infringe anyone's rights;
• post unlawful, harassing, defamatory, pornographic, or privacy-invasive content;
• post personal data of others (addresses, phone numbers, private emails, financial details, etc.);
• impersonate any person or entity;
• upload malware, attempt to exploit vulnerabilities, or disrupt the Service;
• scrape, crawl, or use automated methods to extract data without permission;
• attempt to reverse engineer or bypass access controls.

We may remove content, restrict visibility, or suspend accounts if we reasonably believe you've breached these Terms.

5. Ownership and License

You keep ownership of the content you submit.

By submitting content, you grant Candeq a worldwide, royalty-free, sublicensable license to host, reproduce, modify (for formatting, moderation, and presentation), publish, display, and distribute your content in connection with operating, improving, and promoting the Service (including making it available to search engines and sharing excerpts/previews).

6. Business Invitations and Rewards (Company-Funded)

Businesses may invite users to leave a review and may fund rewards/benefits in connection with those invitations ("Rewards").

• Rewards are offered at the discretion of the inviting business and may change, pause, or stop at any time.
• Candeq may withhold, reverse, or decline to facilitate Rewards where we reasonably suspect fraud, manipulation, policy breaches, or legal risk.
• Users are responsible for any taxes or reporting obligations related to Rewards they receive.
• Businesses are responsible for ensuring their review invitations and Rewards comply with applicable laws and do not require or pressure users to post positive reviews.
• Businesses must offer the same stated Reward regardless of whether a review is positive, negative, or mixed, and must not condition, increase, withhold, or revoke it based on rating or sentiment.
• Businesses must not direct employees, contractors, owners, close affiliates, or other conflicted people to consume customer invitations or Rewards to review their own products.

7. Claimed Business Profiles

If you claim or manage a business profile, you represent that you have authority to act for that business.

You agree not to harass reviewers or attempt to suppress legitimate reviews through threats or incentives tied to review sentiment.

We may remove, suspend, or reassign claimed profiles if we reasonably believe a claim is inaccurate, unauthorized, or abusive.

8. Reviews and Third-Party Products

Reviews and ratings reflect the opinions and experiences of individual users. They are not statements, recommendations, or endorsements by Candeq.

Candeq does not independently verify every statement made in a review and does not guarantee that reviews, ratings, listings, or other third-party content are accurate, complete, or current.

Moderation, approval, invitation, or verification labels describe aspects of how a review was submitted or processed. They do not mean that Candeq has tested, approved, or certified the reviewed product or service.

You are responsible for evaluating a product or service and deciding whether it is suitable for you. You should not rely solely on reviews or ratings displayed through Candeq when making purchasing, financial, security, or other decisions.

The Service may include links to third-party websites or services that we do not control. Content on the Service is general information only and is not professional advice.

9. Disclaimers

The Service is provided "as is" and "as available." We do not guarantee uninterrupted operation, error-free performance, or accuracy/completeness of content.

10. Limitation of Liability

To the maximum extent permitted by law, Candeq is not liable for any loss arising from:

• reviews, ratings, listings, or other content submitted by users or businesses;
• reliance on content available through the Service;
• the purchase, use, performance, failure, security, or availability of a third-party product or service; or
• any act or omission of a reviewer, business, manufacturer, seller, or other third party.

Candeq is not liable for indirect, incidental, special, consequential, or punitive loss, or for loss of profits, revenue, data, digital assets, goodwill, or business opportunities.

Without limiting the above, Candeq expressly disclaims liability for: Lightning network payment failures or delays; cryptocurrency value fluctuations; third-party wallet service outages or errors; and any loss of funds during transmission over the Lightning network.

Nothing in these Terms excludes or limits any right or liability that cannot lawfully be excluded or limited. Where liability cannot be excluded, it is limited to the minimum extent permitted by law.

11. Termination and Enforcement

You may stop using the Service at any time.

We may suspend or terminate accounts, remove content, or restrict access at any time to protect the Service, users, businesses, or for legal/compliance reasons.

12. Communications

We may send service messages related to security, account activity, and important updates.

We may also send marketing emails. You can opt out of marketing emails using the unsubscribe link (or by contacting us). Opting out does not affect essential service messages.

Authentication emails (such as login codes) are essential to the operation of the Service and cannot be opted out of while your account remains active.

13. Changes to These Terms

We may update these Terms from time to time. Continued use after changes means you accept the updated Terms.

14. Governing Law

These Terms are governed by the laws of Victoria, Australia, and you submit to the non-exclusive jurisdiction of the courts of Victoria.

15. Transfer / Restructure

We may transfer (assign) our rights and obligations under these Terms as part of a restructure, incorporation, asset transfer, or sale of the Service. If we do, your rights under these Terms will not be reduced.

17. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Candeq regarding the Service.
